Shipping Terms and Conditions

General terms governing carriage, custody, sender obligations, and carrier liability.

1Definitions

In this shipping agreement, "we," "our," "us," "carrier," and "Tower Crown Logistics", its registered subsidiaries, agents, and operating branches. "You" and "Your" refer to the shipper, receiver, consignee, consignor, and any authorized representatives having an interest in the consignment and acting on behalf of the shipper.

2Agreement to the Terms of Service

This Agreement becomes immediately binding on both parties once we accept your shipment. By dropping off your shipment with us, delivering parcels to our warehouses, sending your shipment to our hubs, or authorizing our team for pickup, you expressly agree to all the terms and conditions contained herein. We reserve the right, at our sole discretion, to revise or modify these terms and conditions at any time. Your continued use of our service constitutes acceptance of any modified terms.

3Your Obligations & Packaging Standards

The shipper warrants that each article in the shipment is accurately described on the shipping document and waybill, and that any export or transit document accepted for transport is correctly marked, addressed, and packaged securely for safe transit. You confirm that there are no dangerous goods or contraband in the shipment and agree to comply strictly with all International Air Transport Association (“IATA”) regulations, national civil aviation protocols, and applicable laws for the carriage of restricted cargo.

Important Notice: You agree to make payment in advance of shipment and acknowledge that the shipment may be delayed, put on hold, or cancelled if cleared payment is not received at least 24 hours prior to scheduled departure.

4Undertaking Against Illegal Use & Fraud

You undertake that all shipments are goods lawfully owned by you and obtained through legitimate means. You agree not to deliver any shipment to us that is not lawfully owned or authorized by you. Any goods obtained through fraudulent, unlawful, or counterfeit means may result in immediate forfeiture, return to sender at your cost, or destruction of the shipment, alongside formal reporting to relevant law enforcement authorities. All handling and legal expenses related to fraud investigations will be borne entirely by the shipper.

5Responsibility for Payment & Carrier Lien

You are primarily responsible for all charges, including transportation rates, weight discrepancy surcharges, customs charges, import duties, and any other government-imposed taxes, levies, fines, demurrage, and clearance fees. Tower Crown Logistics holds a general lien on any goods and shipments in our custody for any unpaid charges or balances due.

6Items Not Acceptable for Transportation

We strictly do not ship physical cash, bank currency, negotiable instruments, original legal or educational certificates, firearms, munitions, hazardous explosives, or prohibited contraband. Certain items may be accepted only to limited destinations under restricted conditions. We reserve the absolute right to reject any package for safety, security, or regulatory reasons.

7Inspection of Goods

Shipments are subject to inspection and physical verification by government authorities (e.g. Customs, NDLEA, Aviation Security) or by us. However, we are not obligated to perform routine physical inspection of every sealed parcel. You agree that we incur no liability for failing to carry out any such inspection.

8Limitation of Liability

Our liability for loss, physical damage, delay, or failure to provide delivery information is strictly limited to standard carriage statutory terms. Customers desiring higher financial coverage must declare item valuation prior to shipment and pay the corresponding premium for third-party cargo insurance.

9Force Majeure

We are not liable for events or delays beyond our reasonable control, including acts of God, actions of public or border authorities, civil unrest, labor strikes, adverse weather anomalies, mechanical airline failures, armed conflict, epidemics, or defaults caused by shippers, senders, or consignees.

10No Warranties

We provide logistics and freight carriage services on a commercially reasonable effort basis. Except as explicitly stated in writing, we make no warranties, express or implied, and disclaim all statutory or implied warranties to the fullest extent permitted by law.

11Export Control and Customs Clearance

You are solely responsible for compliance with all applicable export and import laws, rules, customs declarations, and governmental regulations. You agree to provide all necessary documentation, invoices, permits, and declarations required for customs clearance at origin and destination checkpoints.

12Additional Operational Costs

We may incur reasonable additional expenses due to government directives, storage orders, re-routing recommendations, or local clearance rules, which the shipper and receiver remain jointly liable to settle in full.

13Delivery of Shipment & Authorized Receivers

You agree to nominate authorized persons to accept delivery on your behalf. Specific arrival times on estimated dates are not guaranteed, as line-haul transportation and doorstep delivery remain subject to logistics availability, road conditions, and local clearance speed.

14Claims Procedure & Timelines

Claims for physical damage or missing items must be formally noted and lodged at the point of delivery collection on the delivery receipt. No claims will be entertained until all transportation charges have been fully cleared. No claims will be recognized for parcels signed for and accepted without noting damage on the official delivery record.

15Disposal of Unclaimed Property & Demurrage

Unclaimed shipments left at destination warehouses beyond allowable holding periods will attract daily storage fees. Consignments that remain uncollected despite notice may be returned, re-consigned, or disposed of through auction to recover accumulated storage and logistics expenses.

16Technical Gadget & Electronics Policy

Customers shipping technical gadgets, laptops, phones, and complex electronics must grant permission for operational inspection and battery testing. We disclaim liability for pre-existing internal circuit defects, software errors, or operating system failures during handling.

17Customs Duties and Import Taxes

Customers and consignees are exclusively responsible for all import customs duties, tariffs, and statutory taxes assessed by border agencies. We are not responsible for delivery delays resulting from customs assessments or border clearance procedures.

18Right to Inspection at Point of Handover

We reserve the right to inspect goods at handover points without prior notice. The receiver is equally responsible for physically verifying parcel integrity before signing the handover confirmation slip.

19Routing Discretion

Tower Crown Logistics retains the sole discretion to determine the operational route, transshipment hubs, carrier partners, and conveyance modes for carrying your goods safely to destination.

20Subcontracting & Partner Carriers

We may employ reliable subcontractors, regional couriers, and partner airlines to perform carriage and handling. We contract with reputable providers and operate standard industry supervisory oversight.

Cargo Refund & Claims Policy

Guidelines regarding consignment delay, transit hazards, lost item investigations, and compensation claims.

1Goods Damaged Due to Operational Delays

Our refund policy does not apply to goods damaged as a result of transit delays. It is important to note that most logistical delays are beyond our direct operational control and may be caused by airline backlogs, flight reschedules, or customs inspections. While we make every effort to expedite shipping, delays can occur due to external factors. We cannot be held liable for damage or spoilage incurred during such periods.

Perishable Goods Notice: We strongly advise all perishables, foodstuffs, and agricultural items to be professionally preserved and dried to export standards prior to handover.

2Goods in Transit

We do not provide refunds for goods damaged in transit by natural events, road incidents, or unavoidable third-party mishaps beyond standard carrier scope. While our team exercises every precaution to ensure safe handling, unforeseen transit hazards cannot be indemnified without declared cargo insurance.

3Coverage for Lost Items in Carrier Custody

Our refund policy strictly covers the verifiable loss of complete packages or parts of items lost while under our direct custody during transit. In the rare event of verified loss, our team investigates the matter thoroughly and provides financial compensation according to declared consignment values and regulatory carriage guidelines.

4Claims Window & Submission Procedure

If you believe you are eligible for compensation based on the policy terms, contact our customer desk during working hours. Please provide complete consignment information, including your tracking code, invoices, packing list, item descriptions, and photos of packaging.

5Policy Exceptions & Updates

Our refund policy may be subject to specific contractual terms agreed upon in corporate commercial contracts or statutory legal mandates. We reserve the right to modify or update our refund policies at any time.
